Legal Notice, Product Use and Safety Disclaimer

This Legal Notice, Product Use and Safety Disclaimer applies to the HOUNDRY website, online store, products, content, and related services.

This notice supplements HOUNDRY’s Terms of Service, Privacy Policy, Shipping Policy, Refund Policy, and any product instructions provided with a purchase. If a provision of this notice conflicts with a right that cannot legally be waived or limited, applicable law will control.

HOUNDRY is operated HOUNDRY, doing business as HOUNDRY.

General Information

The information provided through the HOUNDRY website is offered for general product, shopping, and educational purposes. We make reasonable efforts to keep product descriptions, photographs, compatibility information, pricing, availability, and other content accurate. However, errors, omissions, or differences may occasionally occur.

Product photographs and videos may be provided for illustration. Actual colors, finishes, packaging, accessories, dimensions, and minor product details may vary because of lighting, screen settings, manufacturing updates, or other factors that do not materially affect the product’s intended function.

HOUNDRY may correct errors, update information, change product details, or cancel an order affected by inaccurate pricing, availability, or product information, subject to applicable law.

Product Purpose

HOUNDRY HydroWash is intended to assist with routine dog bathing and grooming when used correctly and according to all instructions.

It is not a veterinary device, medical device, plumbing repair product, or substitute for veterinary care, professional grooming assistance, plumbing advice, or other professional services.

Nothing on the HOUNDRY website should be interpreted as veterinary, medical, plumbing, or other professional advice.

Contact a veterinarian if your dog has a medical condition, skin condition, wound, infection, unusual sensitivity, pain, or other health concern that could affect bathing or grooming.

Customer Responsibility

By purchasing or using a HOUNDRY product, you agree to use reasonable care and follow all product instructions and warnings.

Before each use, you should:

  • Inspect the product, hose, seals, fittings, connectors, reservoir, and adapter for visible damage, looseness, cracks, deterioration, or leaks.
  • Confirm that the product and included connectors are compatible with the hose, shower connection, faucet, or water source being used.
  • Make sure each connection is properly installed and secure before turning on the water.
  • Avoid forcing, cross-threading, overtightening, modifying, or using damaged connections.
  • Begin with low water pressure and increase it only as reasonably needed.
  • Test the water temperature and water flow before applying water to your dog.
  • Make sure the bathing area is reasonably safe and that slipping hazards are minimized.

Stop using the product immediately if you notice leaking, cracking, separation, unusual pressure, malfunction, damage, or any other condition that could make continued use unsafe.

Do not continue using a product that appears damaged or defective.

Safe Use Around Dogs

A responsible adult should supervise the dog throughout use.

Use the product calmly and only for its intended purpose. Avoid spraying water directly into the dog’s eyes, ears, nose, or mouth.

Discontinue use if the dog shows significant distress, pain, breathing difficulty, unusual behavior, aggression, or another concerning reaction.

The customer is responsible for determining whether the product is appropriate for the particular dog, bathing environment, water source, plumbing connection, and intended use.

Keep the product and its components away from unsupervised children and animals when not in use.

Water Connections and Property Protection

Plumbing fixtures, garden hoses, shower hoses, fittings, water pressure, installation conditions, and building systems vary.

HOUNDRY does not guarantee compatibility with every hose, fixture, plumbing system, connection type, or water-pressure condition.

The customer is responsible for:

  • Confirming compatibility before use.
  • Installing the product according to its instructions.
  • Checking for leaks before and during use.
  • Monitoring the product while water is running.
  • Turning off the water source after use.
  • Avoiding excessive pressure, excessive temperature, improper installation, unauthorized modification, or use with damaged components.
  • Taking reasonable precautions to prevent slipping, flooding, water damage, or property damage.

HOUNDRY is not responsible for damage resulting from misuse, improper installation, incompatible fixtures, cross-threading, over tightening, excessive pressure, excessive temperature, unauthorized modification, failure to inspect the product, failure to monitor for leaks, or continued use after damage or malfunction becomes apparent, to the fullest extent permitted by law.

Product Results

Individual results and experiences may vary depending on factors including the dog’s size, breed, coat type, behavior, bathing environment, water pressure, water temperature, shampoo, technique, and frequency of use.

HOUNDRY does not guarantee a specific grooming result, bathing time, amount of water saved, or other individual outcome unless expressly stated in a written warranty or guarantee.

Independent Manufacturers, Suppliers and Service Providers

Products sold through HOUNDRY may be manufactured, supplied, stored, fulfilled, or transported by independent manufacturers, suppliers, fulfillment providers, and shipping carriers.

These third parties may make changes to manufacturing, packaging, fulfillment, or transportation processes outside HOUNDRY’s direct control.

Nothing in this section eliminates any responsibility HOUNDRY has under applicable consumer law. It also does not make an independent supplier, manufacturer, carrier, platform, or service provider an employee, partner, joint venturer, or agent of HOUNDRY unless expressly agreed in writing.

Questions or formal communications from a manufacturer, supplier, rights holder, or other business regarding a HOUNDRY product or listing should be sent using our contact page. 

Intellectual Property

Unless otherwise stated, the HOUNDRY name, branding, website text, layout, original photographs, original videos, logos, product names, and other original content are owned by or licensed to HOUNDRY and are protected by applicable intellectual-property laws.

You may not reproduce, publish, distribute, modify, sell, commercially exploit, or create derivative materials from HOUNDRY content without prior written permission, except where permitted by law.

Third-party names, trademarks, product designs, photographs, and other materials remain the property of their respective owners. Reference to a third-party brand, service, connection type, or platform does not imply sponsorship, partnership, endorsement, or affiliation unless expressly stated.

HOUNDRY respects intellectual-property rights. A person or company that believes content on the website infringes its rights should contact us and provide:

  • Identification of the protected work, mark, or other right.
  • Identification of the material in question.
  • The location of the material on our website.
  • The claimant’s name and contact information.
  • A description of the claimant’s ownership or authority.
  • Any supporting registration, license, authorization, or other relevant documentation.
  • A good-faith statement explaining the concern.

HOUNDRY may investigate the request and remove, disable, correct, or replace content when appropriate.

Product Incidents, Defects and Safety Concerns

If a product appears defective, malfunctions, causes an incident, or presents a possible safety concern, stop using it immediately and contact HOUNDRY.

Please provide:

  • Your name and order number.
  • A description of what occurred.
  • Photographs or video when available.
  • The date of the incident.
  • A description of the water source and connection used.
  • Information about any property damage or injury.
  • Whether the product and packaging are still available.

Do not discard a product involved in a reported incident unless instructed to do so or unless retaining it would create an immediate safety risk.

HOUNDRY may request additional information, arrange an inspection, provide safety instructions, communicate with a manufacturer or supplier, issue a replacement or refund when appropriate, or take other reasonable corrective action.

Customers agree to follow any safety alert, corrective instruction, or recall notice issued by HOUNDRY, the manufacturer, a supplier, or an appropriate government authority.

No Unauthorized Modifications

Do not modify, disassemble, drill, cut, permanently alter, or combine the product with unapproved components in a manner inconsistent with its instructions.

Damage or malfunction caused by misuse, improper installation, excessive pressure, excessive temperature, accident, neglect, unauthorized modification, incompatible equipment, failure to follow instructions, or normal wear may not qualify for a return, replacement, or other remedy except where applicable law provides otherwise.

Limitation of Liability

Nothing in this notice excludes or limits liability that cannot legally be excluded or limited. This includes any liability that applicable law makes non-waivable.

To the fullest extent permitted by law, HOUNDRY will not be responsible for indirect, incidental, special, exemplary, punitive, or consequential losses arising from:

  • Improper installation.
  • Misuse or unintended use.
  • Incompatible hoses, fittings, fixtures, or plumbing systems.
  • Excessive water pressure or temperature.
  • Failure to monitor for leaks.
  • Unauthorized modification.
  • Use of damaged components.
  • Failure to follow instructions or warnings.
  • Delays or failures caused by independent carriers, suppliers, platforms, or service providers.
  • Loss of data, business opportunity, anticipated savings, or profits.

For claims that may lawfully be limited and that do not involve non-waivable rights, HOUNDRY’s total liability will not exceed the amount the customer paid HOUNDRY for the specific product giving rise to the claim.

This limitation does not apply to liability arising from HOUNDRY’s fraud, willful misconduct, gross negligence where it cannot be limited, or other conduct for which limitation is prohibited by law.

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, these provisions apply only to the maximum extent allowed.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless HOUNDRY and its owners, employees, contractors, and service providers from third-party claims, damages, liabilities, losses, and reasonable expenses arising from:

  • Your unlawful use of the Services.
  • Your intentional misuse of a product.
  • Your unauthorized modification or resale of a product.
  • Your violation of another person’s rights.
  • Content you submit through the Services.
  • Your material violation of this notice or the Terms of Service.

This provision does not require you to indemnify HOUNDRY for HOUNDRY’s own fraud, willful misconduct, or liability that cannot legally be transferred or limited.

Third-Party Websites and Services

The website may contain links to or integrations with social-media platforms, review platforms, carriers, and other services.

HOUNDRY does not control those third parties and is not responsible for their separate content, availability, privacy practices, security, representations, or terms.

Your use of a third-party service may be governed by that third party’s own policies and agreements.

Informal Resolution of Concerns

Before starting formal legal proceedings, we encourage customers to contact HOUNDRY and provide a reasonable opportunity to investigate and resolve the concern.

Send a written description of the issue, the related order number, the requested resolution, and relevant supporting information using our contact page.

Nothing in this section prevents a person from exercising a legal right that cannot be conditioned on informal resolution.

Governing Law

To the extent permitted by applicable law, this notice and disputes involving the Services or HOUNDRY products will be governed by the laws of the State of Missouri, without regard to conflict-of-law principles.

Any legal proceeding that may lawfully be subject to a Missouri forum will be brought in an appropriate state or federal court located in Missouri.

Nothing in this section deprives a consumer of protections or legal rights that cannot be waived under the law of the consumer’s jurisdiction.

Severability

If any provision of this notice is found invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

No Waiver

HOUNDRY’s failure to enforce a provision of this notice does not waive the right to enforce that provision later.

Changes to This Notice

HOUNDRY may update this notice to reflect changes to products, business practices, suppliers, legal requirements, or the Services.

The revised version will be posted on the website with an updated effective date. Changes will apply prospectively unless applicable law permits otherwise.
